OPINION
ANNE E. THOMPSON, Chief Judge.
This matter is before the Court on appeal by the State of New Jersey and the New Jersey Bureau of Securities from an order issued on December 6,1995 by the bankruptcy court. The December 6th order preliminarily enjoined the State of New Jersey and the New Jersey Bureau of Securities from pursuing litigation in the Superior Court of New Jersey against the debtor, Robert Brennan, and against non-debtors Austin Bernet, Inc. and Roger Barnett. For the reasons set forth in this Opinion, this Court will reverse the ruling and remand the case to the bankruptcy…
