OPINION

BISSETT, Justice.

The City of Edna, defendant-appellee, has filed a motion in this Court to dismiss this appeal on the ground that we do not *438have jurisdiction of the appeal because the order appealed from is interlocutory.

On June 29, 1972, Gerald Vernon West-brook was employed as a truck driver by Craig and Watters, Inc., and was travel-ling East on Highway 59, in Jackson County, Texas, when his truck collided with a truck that was owned by Jerome Tater, d/b/a J & J Enterprises and which was being operated by James Hopes.
