Assumpsit for the support of one William West, during his confinement in the gaol in Paris, in the county of Oxford, whose legal settlement the plaintiffs allege to have been in the district of Hiram, in said county. The following facts were agreed by the parties : William West was committed to prison in Paris, on the 28th of March, 1812, by virtue of an execution ; and he remained in close confinement until the 10th of May following, when he obtained the liberty of the yard, and he was discharged from his imprisonment on the 4th of the ensuing November. The only question arising out of the multitude of facts in this case is, whether the pauper gained a settlement in the district of Hiram, in consequence of having been chosen and duly qualified to act as constable of that district, under the circumstances appearing in the case.. By the sixth article of the second section of the statute of 1793, c. 34, any person being chosen and actually serving, one whole year, in certain offices, among which is included the office of constable, in any town or district, shall thereby gain a settlement therein.
