The action was brought to recover damages which the plaintiff alleges he sustained as the result of a breach of contract entered into by the defendant with the plaintiff whereby the defendant assumed to act in behalf of a domestic corporation *402known as the Continental Guaranty Corporation, of which the defendant was at the time of making the contract and still is the president. It is alleged in the complaint that the said Continental Guaranty Corporation was and is engaged in business of financing incident to the purchase and sale of automobiles.
