Motion for judgment on the pleadings pursuant to section 547 of the Code of Civil Procedure. The action is by servant against master to recover damages received in assisting in the opera- . tion of a threshing machine while in the employ of the master. The complaint alleges that the plaintiff was employed by the defendant to assist in the operation of a threshing machine; that in October, 1914, while the plaintiff was in such employ, working upon such machiné, assisting in the operation and standing upon the steps thereof, the defendant caused a threshing engine to be backed up against and…
