GAJARSA, Circuit Judge.

Kevin F. Coradeschi, a former employee of the Transportation Safety Administration (“TSA”), petitions .us to review the Merit Systems Protection Board (“MSPB”)’s dismissal of his appeal for lack of jurisdiction. On June 28, 2004 an administrative judge (“AJ”) with the MSPB issued an initial decision finding that the MSPB had no jurisdiction to hear Co-radeschi’s appeal because he had not completed the required trial period and therefore was not an “employee” pursuant to 5 U.S.C. § 7511.
