—Order insofar as appealed from reversed on the law and motion denied in part in accordance with the following Memorandum: In appeal No. 1, the People appeal from that part of an order of County Court suppressing defendant’s written statement given at the scene of a fatal hit-and-run accident on the ground that defendant had not been administered his Miranda warnings. Defendant had been out with his friend at some bars and drove his friend home. His friend left the car and, upon attempting to cross the road, was struck and killed by a hit-and-run driver.
