The prolonged path of this litigation began in the summer of 1973, when Rhode Island prison authorities attempted to evict the Inmate Legal Assistance Program from the state’s Adult Correctional Institutions. The district court ordered the state to reinstate the program. Souza v. Travisono, 368 F.Supp. 959 (D.R.I. 1973). The subsequent Supreme Court decision in Procunier v. Martinez, 416 U.S. 396, 94 S.Ct. 1800, 40 L.Ed.2d 224 (1974), mandated affirmance of a portion of this order, and we remanded the balance of the case to the district court for a…
