OPINION

ROBERTS, Judge.

This is an appeal from a conviction for aggravated assault by a male upon a female. Appellant plead guilty before the court and his punishment was assessed at confinement in the qounty jail for six months.

Appellant'asserts seven grounds of error. In his first ground of error, he contends that the statute under which he was convicted [Art. 1147(9), Vernon’s Ann.P.C.] is unconstitutional. He contends that since the statute makes any assault or battery committed by an adult male upon an adult female an aggravated assault, but makes an assault by an adult female upon another…
