This is a suit upon a promissory-note for $50. Upon appeal to the circuit court the jury found in favor of the defendant; but judgment non obstante veredicto was entered for the plaintiff. The controversy is now before us on case-made. This note, in the usual form of promissory notes, was given by the defendant to the plaintiff. It is claimed by the plaintiff that, incident to its reorganization, this note was given to it in payment of defendant’s subscription for five shares of stock.
