This is a suit upon a surety bond. It was issued by defendant to the plaintiffs under the following circumstances:

The plaintiffs, Mr. and Mrs. Masters, were the owners of a beer and grocery store in the city of Port Huron. Mr. Masters was a farmer and his son operated the store for him until September of 1952, .when he (the son) decided to go into business for himself. Mr. Masters then approached Albert Ellis about running the store and between them they reached an agreement.
