The exception here is to a judgment of the superior court awarding the custody of a minor about four years of age to her maternal grandfather.
In the father’s petition for habeas corpús, he alleged: In January, 1944, when the child was bom and the mother died, he was serving in the United States Army, but was home on leave at that time.
