The appeal of the Southern Pacific Railroad Company (care No. 494) will first be considered. It will be convenient to designate the parties plaintiffs and defendants, as they were in the court below., It is contended on the part of the plaintiffs that all the questions involved in the present case with respect to the lands in controversy have been considered in other cases and determined, and, having passed to final judgment, are now res judicata.
