FORRESTER, District Judge.
This matter is before the court on issues raised by defendant Travelers Insurance Company’s petition for removal. 28 U.S.C. §§ 1441(a), 1446. Plaintiff’s complaint, brought pursuant to O.C.G.A. § 33-4-6 (bad faith failure to pay insurance proceeds), was filed in September 1987 in the Superior Court of DeKalb County. By defendant’s petition filed October 30, 1987, this action was removed to this court. Jurisdiction is premised upon 28 U.S.C. § 1332(a)(1) (diversity of citizenship).
