delivered the opinion of the court:
Angelo Isabelli (plaintiff) brought this action against Cowles Chemical Company (Cowles) for alleged violation of the Structural Work Act. (III. Rev. Stat. 1971, ch. 48, pars. 60 — 69.) Cowles filed a third-party action against Martin Marietta Corporation (Marietta). The third-party complaint sought indemnity from Marietta on grounds of implied indemnity and active negligence.
