—Judgment, Supreme Court, New York County (William Wetzel, J.), rendered April 8, 1999, convicting defendant, after a jury trial, of criminal sale of a controlled substance in the third degree, and sentencing him, as a second felony offender, to a term of 5 to 10 years, unanimously affirmed.
The court properly denied defendant’s application for a missing witness charge concerning the “ghost” officer. The court properly found this request to be untimely, since it was made after the close of evidence and the record fails to support defendant’s assertion that it was made “as soon as practicable”…
