delivered the opinion of the court.. The appellant in this case was bound over to the Criminal Court of Cook county by a police magistrate on August 15, 1903, on a complaint in bastardy ^proceedings by Anna Zelvic. On December 2, 1903, he pleaded not guilty in the Criminal Court, and an issue was made up, as required by the statute, as to whether the defendant was or was not the real father of the child of the complaining witness, Anna Zelvic.
