—In an action, inter alia, to recover damages for fraud, the plaintiff appeals, as limited by his brief, from so much of an order of the Supreme Court, Suffolk County (Oshrin, J.), dated June 18, 1998, as granted that branch of the defendant’s motion which was for partial summary judg*281ment on the third counterclaim to recover damages for defamation on the issue of liability.
Ordered that the order is affirmed insofar as appealed from, with costs.
