—In an action to recover damages for libel, the plaintiffs appeal from an order of the Supreme *472Court, Westchester County (Lefkowitz, J.), entered April 16, 2002, which granted the motion of the defendant Leke Gojcaj, in effect, pursuant to CPLR 3211 (a) (7) to dismiss the complaint insofar as asserted against him for failure to state a cause of action, and denied their cross motion for summary judgment on the complaint.

Ordered that the order is modified, on the law, by deleting the provision thereof granting the motion and substituting a provision therefor denying the motion; as so modified,…
