(dissenting).* On April 14, 1931, Sidney L. Blauvelt was committed to the Buffalo State Hospital for the Insane. His condition was diagnosed as being maniac depressive psychosis form of insanity. Nine months after his admission to the State hospital and on the 27th day of January, 1932, he was assaulted by another patient of the institution, Frank H. Baldwin, and on the same day died as a result of the injuries inflicted upon him during the course of the assault.
