SIMMS, Justice:

In a divorce action, the trial court awarded custody of three-year-old Danny Gordon to his father, Gary Gordon. His mother, Maxine Gordon, now Frank, appeals. We reverse the Trial Court.

Maxine Gordon filed this action for divorce in January of 1975, alleging that through the defendant’s fault the parties had become incompatible. She sought custody of Danny, who was then two-years-old; child support; alimony and division of property. By ex parte order, Danny’s temporary custody was placed with the plaintiff and defendant was ordered to make payments for the support of plaintiff…
