This is an action brought in the district court of Red Willow county against Louis Lowenstein, defendant in error, and others, upon a supersedeas bond given by one Emil Linder, administrator of the estate of Samuel Hirsch, deceased, upon which defendant in error Lowenstein, J. E. Kelley, and S. Strasser were sureties. No service seems tio have been made or attempted upon any of the parties to said bond except defendant in error. Plaintiff in error in his petition sets np the execution and approval of the supersedeas bond, of which a copy is set out. Defendant in error answered,…
