This case raises the question of whether filing of a proof of claim based upon a time-barred debt violates the Federal and Maine Fair Debt Collection Practices Acts and the Bankruptcy Code.1 The issue is before me on defendants LVNV Funding, LLC and Resurgent Capital Services’ motion to dismiss the complaint of plaintiffs David A. Martel and Cheryl A. Martel.
