SMART, Judge.

This is an action for collection of dues and special assessments imposed by a home owners association. Donald and Elizabeth Martin own three lots in a fence-enclosed subdivision located in Independence, Missouri, known as The Dominion. The Dominion Home Owners Association, Inc. (“ the Association”) filed an action against the Martins, attempting to collect annual assessments (dues) and other assessments. Both parties filed motions for summary judgment.
