PELPHREX, Chief Justice.

Appellee and his wife, Sallie Teressa Or-son,' on October ■ Í, 1928, executed twenty promissory notes payable to the American Trust Company. Notes- 1 to 19, inclusive, were for $200’ each and payable one each six- months beginning on May 15, 1929. Note No. 20 was for the sum. of $4,200 and was payable on November 15, 1938. These notes were secured by a deed of trust on certain property belonging to Orson and wife in the town of Midland, Tex. The notes carried 6 per cent, interest evidenced by interest coupons attached thereto.
