In this case we consider whether contracts for the purchase of two condominium units were voidable by the purchasers on the ground that the seller/developer failed to maintain the deposits paid by the buyers in escrow in the manner required by the Condominium Act, §§ 718.101-.708, Fla. Stat. (2006). In CRC 603, LLC v. North Carillon, LLC, 77 So.3d 655 (Fla. 3d DCA 2011), the Third District Court of Appeal held that the contracts were voidable under the escrow provisions of the Condominium Act that were in force in 2006, when the contracts were entered.
