This matter was initiated on September 15, 2005, by a petition for a writ of habeas corpus pursuant to Title 28, United States Code, Section 2254, filed by Robert Stacy Yarbrough (“Yarbrough” or “petitioner”). On June 26, 1998, petitioner was convicted of robbery and capital murder and was sentenced to life imprisonment for robbery and death for capital murder.
