The plaintiff appeals from an order setting aside a final decree of divorce. The evidence in support of the motion to set aside the final decree establishes that appellant filed an action for divorce from respondent in San Francisco while respondent was in the armed forces of the *687United States. There was submitted to respondent for his signature a waiver of his rights under the Soldiers’ and Sailors’ Relief Act of 1940, and a property settlement agreement.
