RULING AND ORDER

MARK R. KRAVITZ, District Judge.

Currently before the Court is Defendants’ Motion for Summary Judgment [doc. #37]. In her Complaint, Plaintiff Donna Dutko alleges that Defendants violated her constitutional rights when they excluded her property (“75 High”) from the Milford Center Design Development (“MCDD”) zone, a mixed-use zoned area adopted by the City of Milford on Decern- ber 2, 2003. See Complaint [doc. # 1]. Ms. Dutko’s property, which she purchased in 1994, was at the time of her purchase and is to this day zoned R-7.5, a residential zoned area.
