Mrs. Lucy Robson, as executrix of the last will of W. S. Robson, sued Dr. T. Warren Moore and H. B. Kaulbach, alleging that the estate of W. S. Robson is the owner of one-eighth of three certain tracts of land in Fayette county, and that defendant Moore owns the other seven-eighths thereof, but that defendant Kaulbach has a mortgage upon Moore's interest therein; that plaintiff and Moore both claim title from a common source, to wit, T.
