TUNKS, Chief Justice.

On the evening of April 16, 1965, four young men, David Lively, Jr., Joseph Boze, Larry Stephens and Christy Burns, each of whom was either 17 or 18 years of age, met in Pasadena, Texas. After some discussion they decided to drive to the west beach of Galveston Island to join a beach party of some of their high school friends.
