This is an action by the widow and minor children of Joseph Hanson, deceased, to recover damages for his wrongful death, which they claim was caused by the negligence of the defendant. The deceased was employed as a switchman in the defendant’s yards at Seattle. At about 10:15 o’clock, on the night of August 30, 1911, a switching crew consisting of the engineer, fireman, the switch foreman, the deceased and another switchman, were engaged in transferring a string of twenty-five loaded coal cars from another track to the scale track for weighing.
