*270This suit was brought June, 1902, in the circuit court of Roane county, by A. P. Thompson and his wife, Ruth C. Thompson, in the right of the latter, against the defendant, to recover damages for injuries sustained by her on August 28, 1899, while she was attempting to take passage on one of defendant’s trains at Rockwood, Tenn., caused by the defective condition of the station platform, she being then and yet under coverture.
