MEMORANDUM OPINION AND ORDER
MONTGOMERY, District Judge.
I. INTRODUCTION
The above-entitled matter came on for hearing before the undersigned United States District Judge on February 18, 1998, pursuant to Canadian Pacific Railway’s (“CPR” or “Plaintiff’) Motion for Summary Judgment. CPR seeks to demolish five buildings on one of its rail yards in the Twin Cities, but the City of Minneapolis (“the City” or “Defendant”), through its Departments of Planning and Inspections, has refused to issue the requisite demolition permits.
