Appellee filed suit against appellant-to foreclose a mortgage on certain real estate given to secure the payment of a promissory note for the sum of $9,000, interest etc., alleging in his complaint that appellant had failed to pay interest and taxes due, and, that by the terms of said mortgage deed the whole sum secured thereby became due and payable. The note provided “ * * and if the same shall not be paid when due, we jointly and severally promise and agree to pay all costs of collection, including reasonable attorney’s fees, if suit be brought-on this note or if…
