I. INTRODUCTION

This matter comes on before this court on the appeal of the United States from an order entered in the district court on June 13, 2001, disqualifying the United States Attorney’s Office for the Eastern District of Pennsylvania from representing the United States in this criminal prosecution for mail fraud in violation of 18 U.S.C. § 1341. The order also directed the Attorney General forthwith to appoint an attorney to represent the Government in the case and required the special attorney to advise the court by August 15, 2001,…
