This matter came before the Supreme Court on November 8, 1995, pursuant to an order directing all parties to appear and show cause why the issues raised in this appeal should not be summarily decided. In this case the defendant third-party plaintiff, Mariner Square Condominium Association (Mariner Square), appeals from the Superior Court order granting the summary judgment motion of the third-party defendant, Robert Ferrier, d.b.a.
