Ora Cole, natural mother of Mary Jane Cole, now age 15, and Martha Lynn Cole, now age 12, filed in this court a petition for a writ of habeas corpus seeking the custody of her children from their stepmother, the respondent Donna Cole, who has actual but not legal custody of the children. Petitioner alleged that she is the divorced mother of the children; that their father, Roy Cole, who had previously been given legal custody of the children by order of the divorce court, died on September 29, 1954; that she made demand for the children on respondent, widow of Roy Cole,…
