The plaintiff’s counsel moved for a mandamus to the judge of the First Judicial District, commanding him to permit an execution to be issued in this case. He represents that the defendants, against whom a judgment was rendered below, obtained an order of appeal which was made returnable in this court on the fifth Monday of March, 1845; that, on the 9th of April, after the lapse of more than three judicial days from the return day, he obtained from the clerk of this court a certificate that the transcript had not been filed; that he presented this certificate to the district judge, who refused…
