HOOD, Judge.

This is an action to annul and rescind two acts of sale, or in the alternative to recover damages. After trial of the case on its merits, judgment was rendered on June 28, 1957, in favor of defendants, dismissing plaintiff’s suit and the judgment was read and signed on the same day. On May 23, 1958, plaintiff applied for and was granted a devolutive appeal, returnable to-*407the Supreme Court on July 22, 1958, and personal service of the order granting the appeal was duly made on the defendant-appellee.
