This case originated in the former Municipal Court of Puerto Rico, Mayagüez Section. On appeal, the District Court, Mayagüez Section, held a trial de novo under the Acts *81then in force,1 and entered judgment dismissing the complaint. On July 30, 1952, this Court granted certiorari to review the judgment thus rendered.

The findings of fact of the court a quo, which have not been challenged, are the following:
