This is an action of trespass to recover damages for the unlawful expulsion of the plaintiff from a train on the defendant’s road. There is no dispute as to the material facts. On Sunday, August 20th, 1893, the plaintiff asked the ticket agent of the defendant company at Westminster, Maryland, for a round-trip ticket to Emory Grove Camp. The agent gave him a ticket to Glyndon and return, and called his attention to the fact that the Emory Grove tickets were not sold on Sundays, but that the Glyndon ticket would do as well, since the two stations were only a quarter of a mile apart.
