On September 8, 1969, the defendant was indicted on charges of armed robbery, contrary to § 40A-16-2, N.M.S.A.1953 (2d Repl. Vol. 6); kidnapping, contrary to § 40A-4 — 1, N.M.S.A.1953 (2d Repl. Vol. 6); aggravated assault, contrary to § 40A-3-2 (A), N.M.S.A.1953 (2d Repl. Vol. 6); and aggravated battery, contrary to § 40A-3-5, N.M.S.A.1953 (2d Repl. Vol. 6).
