This was a suit for partition of land, brought by the appellees against the appellant. The complaint alleged that the appellees were the heirs at law of their mother, Casba Hatfield, deceased; that during her life she was possessed, in her own right, of a large sum of money, and purchased therewith, of one Emerson Jester, certain land described, in Grant county, Indiana; that the deed therefor was executed, acknowledged and delivered to said Casba Hatfield in her own right, and as her separate property and estate; that she was the wife of David Hatfield, who survived her; that, after…
