On December 9, 1998, a grand jury in the Western District of Wisconsin returned a three count indictment against appellant Gary R. Roth (“Roth”), charging him with conspiracy to manufacture and distribute marijuana, possession with intent to manufacture marijuana, and criminal forfeiture, in violation of 21 U.S.C. § 846 and 21 U.S.C. § 841(a)(1).
