Defendant in error, H. Lawson Gray, on September 27, 1917, filed this suit in the district court of Jefferson county in trespass to try title against the plaintiffs in error, W. L. Pondrum, receiver of McEad-den-Wiess-Kyle Land Company, a joint-stock company, and W. P. H. McEadden, W. W. Kyie, Percy Wiess, Laura E. Wiess, Mrs. Ruth Sergent, and Paul 0. Sergent, to recover about 100 acres of land situated on the J. 5. Johnson, survey in said county, and for rents in the sum of $4,000.
