This is an action brought to recover damages for personal injuries sustained by plaintiff and. alleged to have been caused by the plaintiff having been struck by an automobile, owned and operated by defendant.

Plaintiff alleges, among other things, that Main Street is a business street in the city of Helena, with Grand Street abutting on it; that a street-car track, on which street-cars are operated, extends, north and south, on Main Street, past the place where Grand Street abuts on Main, and that at that place there is a stopping place for street-cars; that, in the afternoon of October 5,…
