This was an action by Mary Jane Heath against Bates Miller and others, for the recovery of a described parcel of land. The trial resulted in a judgment for the defendants, and the plaintiff assigns error upon a judgment overruling her motion for a new ■trial.

On May 20,1845, Meredith conveyed to McWhorter, as trustee, the land in controversy ; that portion of the deed which is material to the present discussion being in the following words: “ In trust always, nevertheless, and for the sole and separate use, benefit, and behoof of Mrs. Martha E.
