OPINION AND ORDER
PIERAS, District Judge.
The Court has before it several post trial motions. The individual state defendants Dr. Gumersindo Blanco, Dr. José R. González Inclán, and Dr. Pedro J. Santiago Borrero have filed a Motion for Judgment Notwithstanding the Verdict (judgment n.o.v.) under Rule 50(b) of the Federal Rules of Civil Procedure or for a New Trial pursuant to Rule 60(b)(1) and (3) of the Federal Rules of Civil Procedure. This motion also incorporates a request for New Trial under Rule 59 because defendants claim they were prejudiced by surprise testimony presented at the trial.…
