In this action the plaintiff in error was sued by the defendants in error and judgment rendered on the pleadings in favor of the defendants in error. The parties will be referred to herein as they appeared in the trial court.

In order to get clear conception - of the issues involved in this appeal, it is necessary to consider the allegations of the defendant. The plaintiffs prayed for a judgment on a promissory note signed by the defendant, alleging valuable consideration, maturity of the note, and failure to pay.
